Welcome to PhotoMeh. These Terms and Conditions ("Terms") govern your use of our AI-powered car damage estimation service available at https://photomeh.com ("Service"). By accessing or using PhotoMeh, you agree to be bound by these Terms. If you do not agree, please do not use our Service.

1. Service Description

PhotoMeh provides an AI-powered damage estimation service for vehicles. Users can upload photographs of damaged vehicles, and our artificial intelligence system analyzes the images to generate repair cost estimates. The Service includes:

• Vehicle damage photo upload and storage
• AI-powered damage detection and analysis
• Estimated repair costs including parts and labor
• Damage severity assessments
• Report history and management through user dashboard

2. Account Terms

2.1 Account Creation

To use PhotoMeh, you must create an account using one of the following methods:

• Email and Password: Create an account with your email address and a secure password (minimum 8 characters, including uppercase, lowercase, and special character)
• Google Sign-In: Sign in using your existing Google account through OAuth authentication

You are responsible for:

• Maintaining the security of your account credentials
• All activities that occur under your account
• Ensuring the accuracy of your account information
• Keeping your password confidential and notifying us of any unauthorized access

2.2 Eligibility

You must be at least 18 years old to use PhotoMeh. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3. Fees and Payment

3.1 Pricing

PhotoMeh charges a per-report fee for damage estimates. Pricing varies by region and is displayed in your local currency based on your location:

• United States: $1.99 USD
• European Union: €1.99 EUR
• United Kingdom: £1.69 GBP
• Canada: $2.49 CAD
• Australia: $2.99 AUD

Prices may be subject to change with prior notice. The applicable price will be clearly displayed before you complete your purchase.

3.2 Promotional Codes

PhotoMeh may offer promotional codes through authorized influencers and partners. Promo codes provide discounts on damage reports and are subject to the following conditions:

• Codes may have usage limits or expiration dates
• Codes cannot be combined with other offers
• We reserve the right to invalidate codes suspected of abuse
• Minimum payment amounts may apply after discounts (typically 50 cents)

3.3 Payment Processing

All payments are processed securely through Stripe. We accept major credit and debit cards, as well as Apple Pay and Google Pay where available. By making a payment, you agree to Stripe's terms of service. We do not store your payment card details on our servers.

3.4 Refund Policy

Due to the instant nature of AI-generated reports, payments are generally non-refundable once a report has been generated. However, we may consider refunds on a case-by-case basis if:

• A technical error prevented report generation
• The service was unavailable or malfunctioned
• The report was significantly incomplete due to system issues

To request a refund, please contact us within 7 days of the transaction.

4. AI Estimation Disclaimer

You acknowledge and agree that:

• Estimates are not professional appraisals, insurance quotes, or legally binding assessments
• Actual repair costs may vary significantly based on location, labor rates, parts availability, hidden damage, and other factors
• AI analysis is based on visible damage in uploaded photos and may not detect all damage
• Estimates should not replace professional inspection by qualified mechanics or certified appraisers
• PhotoMeh is not responsible for decisions made based on our estimates

5. Acceptable Use

When using PhotoMeh, you agree NOT to:

• Upload images that are not related to vehicle damage assessment
• Upload illegal, offensive, or inappropriate content
• Attempt to manipulate or deceive the AI system
• Use the Service for fraudulent insurance claims
• Reverse engineer, decompile, or attempt to extract the source code
• Interfere with or disrupt the Service or servers
• Use automated systems (bots) to access the Service without permission
• Violate any applicable laws or regulations
• Infringe upon the rights of others

6. Intellectual Property

6.1 Your Content

You retain ownership of all images you upload to PhotoMeh. By uploading content, you grant us a limited, non-exclusive license to:

• Store and process your images for damage analysis
• Generate and store damage reports associated with your account
• Use anonymized data to improve our AI models (with no personally identifiable information)

6.2 Our Content

The PhotoMeh service, including its design, features, AI models, and generated reports format, is owned by PhotoMeh and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

7. Cookies and Analytics

PhotoMeh uses cookies and similar technologies to provide and improve our Service. By using our Service, you acknowledge our use of cookies as described in our Privacy Policy.

7.1 Essential Cookies

We use essential cookies that are necessary for the operation of our Service. These include cookies for authentication, session management, and storing your preferences. These cookies cannot be disabled as they are required for basic functionality.

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you upload to the Service

10. Account Termination

We reserve the right to suspend or terminate your account at any time if:

• You violate these Terms
• You engage in fraudulent or illegal activity
• You abuse the Service or other users
• We are required to do so by law

You may delete your account at any time. Upon termination, your right to use the Service ceases immediately, and we may delete your data in accordance with our Privacy Policy.

11. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Effective Date." Your continued use of the Service after changes constitutes acceptance of the modified Terms.

12. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the Republic of Latvia, without regard to conflict of law principles. If you are located in the European Union, you also retain protections afforded by the laws of your country of residence under applicable EU consumer protection regulations.

Any disputes arising from these Terms or your use of the Service shall be resolved through good-faith negotiation first. If negotiation fails, disputes will be submitted to the courts of Riga, Latvia, which shall have exclusive jurisdiction.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
